xAI faces lawsuit over Mississippi data center turbines

The NAACP, a civil rights organization, has filed a lawsuit against xAI, alleging that the company is operating nearly 50 gas turbines at its Mississippi data center without state regulation. The legal dispute centers on a regulatory loophole regarding how the power plants are classified. The turbines are considered “mobile” by the state of Mississippi because they are sitting on flatbed trailers. This classification allows the company to avoid air pollution regulations for one year. On behalf of local residents, the NAACP filed the lawsuit and, this week, asked the court for an injunction against xAI to halt the turbine operations.
The Southern Environmental Law Center, an environmental legal advocacy group that filed the lawsuit on behalf of the NAACP, argues that the turbines are being operated in violation of federal law. According to the legal challenge, federal law states that power plants mounted on trailers can still be considered stationary and therefore subject to standard air pollution regulations. The lawsuit emphasizes the local environmental impact of the setup, with the NAACP reporting that unchecked emissions from the turbines are worsening air quality in an already polluted region.
The dispute comes as xAI has expanded its power generation capacity at the site beyond its permitted limits. While xAI was granted permits for 15 of its turbines, the company has continued to install additional units. Previously, the Greater Memphis Chamber of Commerce, a business advocacy organization, issued a press release regarding turbine operations, which stated that about half of the 35 turbines in operation in May 2025 would remain on-site. However, xAI has continued to install more. Currently, 46 turbines are operating at the Mississippi facility.
